Terms and Conditions of Use

These Terms and Conditions (the “Agreement”) govern the use of the Mon application and the rodriguezstudio.es website (the “Platform”), owned by Francisco Rodríguez. By registering or using the Platform, you accept this Agreement, the Privacy Policy and the Community Guidelines.

You are responsible for the confidentiality of your credentials and for all activity on your account. You must notify us of any unauthorised use at monsocial@rodriguezstudio.es.

4. Rules of conduct and content

By using the Platform you undertake to respect the Community Guidelines. The following is prohibited, among other things:

We reserve the right to moderate, remove content and suspend or cancel accounts that are in breach, in accordance with the Moderation Policy.

5. Adult content and 18+ communities

The Platform is reserved for adults and some communities may be marked as adult (18+) content. Pornography and explicit nudity are not permitted in profiles, public photos, stories or meetups, in accordance with Apple App Store and Google Play rules. You can adjust the visibility of adult content from the app settings. The detail of what is allowed and where is set out in the Community Guidelines.

6. Content and user responsibility

All content published by users (profiles, photos, stories, messages, communities, meetups and services) is the responsibility of whoever publishes it. Mon hosts that content but does not adopt it as its own. Communities are administered by their owners and moderators, who are responsible for managing them within these rules and the law; Mon may intervene in accordance with its Moderation Policy.

7. Licence for user content

You retain ownership of the content you publish. You grant us a worldwide, non-exclusive, free and transferable licence to host, store, reproduce and display that content for the sole purpose of operating and providing the service. This licence ends when you delete the content or your account, except for technical or backup copies and legal retention obligations.

8. “Real person” verification

The verification badge is an optional and free feature indicating that a liveness check has been passed on the device. It is not an identity check nor a guarantee as to the conduct, intentions or background of any person. The biometric processing takes place on your device and is not retained; see the Privacy Policy.

9. Application licence (EULA)

We grant you a personal, limited, revocable, non-exclusive and non-transferable licence to use the app on your devices. You may not copy, modify, decompile or reverse engineer the app except to the extent permitted by law.

Apple App Store specific conditions: this Agreement is entered into between you and Francisco Rodríguez, not with Apple. Apple has no obligation to provide support or maintenance. In the event that the app fails to comply with applicable legislation, you may notify Apple, which may refund the purchase price (if any); Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of this Agreement. Apple’s “Licensed Application End User License Agreement” applies where relevant.

10. Paid services: Premium, Boost, meetups and services

The paid features (Premium subscription, Boost, paid meetups and paid individual services) are additionally governed by the Terms for payments, subscriptions, meetups and services, including the right of withdrawal and the refund policy.

11. Advertising

The Platform may display advertising to users who do not have an active Premium subscription. Ads are served through external providers (Google AdMob) and, in the European Economic Area, require your consent through the consent platform shown in the app. The Premium subscription removes advertising. 13. Suspension and cancellation

We may suspend or cancel your access, with or without prior notice, if you breach this Agreement or the law, or if your conduct poses a risk to other users or to the Platform. You may cancel your account at any time from the app (see Account and data deletion).

14. Warranties and liability

The Platform is provided “as is” and “as available”. We do not guarantee that you will meet specific people, nor the outcome of interactions, meetups or services. We are not responsible for the conduct of users nor for the encounters that take place inside or outside the Platform; we recommend following the Safety Tips.

To the extent permitted by law, our liability is limited to direct and foreseeable damages. Nothing in this Agreement limits the non-waivable statutory rights to which you are entitled as a consumer.

15. Amendments

We may amend this Agreement. We will inform you of substantial changes with reasonable notice through the app or by email, and we may ask you to accept the Terms again. Continued use after entry into force implies acceptance.

16. Applicable law and dispute resolution

This Agreement is governed by Spanish law. As a consumer, you may bring proceedings before the courts of your place of residence and use the European online dispute resolution platform: https://ec.europa.eu/consumers/odr. Contact: monsocial@rodriguezstudio.es.
